Hosting and server log files

This website is hosted on GitHub Pages, a service of GitHub, Inc., 88 Colin P. Kelly Jr. Street, San Francisco, CA 94107, USA. When you open a page, your browser automatically transmits data that GitHub records in server log files — in particular your IP address, the requested file, browser type and version, operating system, referrer URL and the time of the request.

This processing is necessary to deliver the site securely and reliably, and is based on our legitimate interest pursuant to Art. 6 (1) (f) GDPR. GitHub, Inc. is certified under the EU–U.S. Data Privacy Framework; transfers to the USA are additionally covered by standard contractual clauses. Details: GitHub Privacy Statement.

Cookies and fonts

This site sets no cookies of its own and loads no external fonts — the typefaces used are the ones already installed on your system. The only cookie that may be set comes from the analytics service described below.

Web analytics (Statcounter)

We use Statcounter (Statcounter, Unit 3, Sandyford Office Park, Dublin 18, Ireland) to understand how the site is used — for example which pages are opened and which browser and screen size visitors use. Statcounter sets one technical cookie to tell new visitors from returning ones. IP addresses are truncated and not stored in full permanently; the data is held on European servers.

Legal basis is our legitimate interest in a needs-based design of this website pursuant to Art. 6 (1) (f) GDPR. Details: Statcounter legal & privacy.

Beta download form (double opt-in)

The download for the beta is sent by e-mail. When you enter your address in the form, the following happens:

• We store your e-mail address, the time of the request and the version you requested.
• You receive a confirmation e-mail. The download link is only sent after you click the link in it (double opt-in).
• Your IP address is not stored in plain text. It is turned into a one-way hash and kept briefly, solely to rate-limit abuse of the form.

Legal basis is your consent pursuant to Art. 6 (1) (a) GDPR, given by confirming the e-mail. You can withdraw it at any time with effect for the future — an informal e-mail to hello@smartmarkers.tools is enough, and we will delete your address. Beyond that we keep the address for as long as the beta programme runs, in order to send you updates about it, and delete it when the programme ends.

The form is processed on server infrastructure operated by STRATO AG, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany, acting as our processor under Art. 28 GDPR. Your address is not passed on to anyone else and is not used for unrelated advertising.

Contacting us by e-mail

If you write to us, your message and the address you used are stored so that we can handle your enquiry. Legal basis is Art. 6 (1) (f) GDPR, and Art. 6 (1) (b) GDPR where your message relates to a contract or pre-contractual steps. We delete this data once it is no longer needed, unless statutory retention periods apply.

Your rights

Under the GDPR you have the right to obtain information about the personal data we hold about you (Art. 15), to have it corrected (Art. 16) or erased (Art. 17), to restrict its processing (Art. 18), to data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). Where processing rests on consent, you may withdraw that consent at any time with effect for the future.

To exercise any of these rights, write to hello@smartmarkers.tools. You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the member state of your residence, place of work or the place of the alleged infringement.

The SmartMarkers software

The application itself is not covered by the processing described above. Analysis runs entirely locally on your own Mac: audio files never leave your computer, and no analysis results, project data or usage statistics are transmitted to us. During installation the software downloads its analysis models from Hugging Face and its Python dependencies from PyPI; those requests go directly from your machine to those providers and are subject to their own privacy policies.
